1. Youth Justice Resource Hub Terms of Use

This agreement is between the Youth Justice Board (‘We’) and the user of this Site (‘You’) (‘the parties’).

The Youth Justice Resource Hub is maintained for Your personal use. These Terms of Use (‘Terms’) (along with any documents referred to in it) sets out the terms of use on which You may use our website https://yjresourcehub.uk/ (‘the Site’), whether as a guest or registered user. Use of our Site includes accessing, browsing or registering to use our Site.

In consideration for the use of our Site, You shall agree to our terms. Please read these Terms carefully before You start to use our Site, as these will apply to the use of our Site. You shall use our Site only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, this Site by any third party.

The most up-to-date version of our information will always be that available on the Youth Justice Resource Hub website. The Google translate service available on this site is a means by which the Youth Justice Resource Hub offers automated translations of site content. The English content as directly provided should always be considered the authoritative version. The use of the Google Translate function and/or content is also subject to the site policies, which govern the use of the Youth Justice Resource Hub information services and content.

The Youth Justice Resource Hub may contain links to third-party websites or services that are not owned or controlled by Youth Justice Board. Where our Site contains links to other Sites and resources provided by third parties, these links are provided for Your information only. The Youth Justice Board has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. We will not be liable for any loss or damage caused or alleged to be caused by or in connection with Your use of or reliance on any such content, goods or services available on or through any such websites or services. We strongly advise You to read the terms and conditions and privacy policies of any third-party websites or services that You visit.

7. Accessing our Site
Our Site is made available free of charge.

We do not guarantee that our Site, or any content on it, will always be available or uninterrupted. Access to our Site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our Site without notice. We will not be liable to You if for any reason our Site is unavailable at any time or for any period.

8. Information about You and Your visits to Youth Justice Resource Hub
We may collect information about Your visits to the Youth Justice Resource Hub in accordance with our privacy policy. By using our Site, You consent to such processing and You warrant that all data provided by You is accurate.

9. Youth Justice Interactive Learning Space
The Youth Justice Interactive Learning Space (YJILS) and its courses are sponsored by the Youth Justice Board, who will require details about you, such as your name, your workplace, your frequency of access, the courses you study, and your results. It is a condition of your access to the YJILS that you agree to the YJB releasing this information to your manager and the Youth Justice Board.

In accordance with the Data Protection Act, YJB will create a record in your name and we may use the information you provide to contact you, offer services, carry out course evaluations and/or carry out research to help us plan and improve our services. By providing this information you are giving us explicit consent to use this data.

The registration key has been set up for employees and volunteers of the YOT it has been assigned to. Under no circumstances should it be passed on to other organisations / people. Misuse of the registration key will result in the withdrawal of access to the Site for that YOT.

10. Submitting content
In submitting materials to the Youth Justice Resource Hub You thereby:

  • Authorise us to make these materials available in the area to which You are submitting and to present them in accordance with any YJB Classification System or categorisation.
  • Confirm that if any of the material was originated by a third party You have their consent to submit it, and undertake to indemnify the YJB in respect of any claims made by a third party alleging breach of copyright or other intellectual property rights.

Any content that You submit to our Site will be considered non-confidential and non-proprietary. If any submission includes materials or information You would not wish to make freely available (for example, commercially-sensitive information, or resources for which there is normally a cost attached) please specify this or contact us on the above email address for more information.

You are solely responsible for securing and backing up Your content.

You retain all of the ownership rights of any Content You submit to the Youth Justice Resource Hub, but You are required to grant limited licence rights to the Youth Justice Board and other users of the site. These are described in the section Rights You licence, below.

11. Rights you licence
When You submit Content to the Youth Justice Resource Hub, You grant:

  • To the Youth Justice Board a non-exclusive, royalty-free, transferable licence (with right to sub-licence) to use, reproduce and present Your Content in connection with the provision of our Site.
  • To each user of our Site a, non-exclusive, royalty-free licence to access Your Content on our Site, and to use, reproduce and present Your Content to the extent allowed our Site and under these Terms.

The above licences granted by You in Content terminate when You remove or delete Your Content from our Site. The above licences granted by You are continuous and irrevocable, but are otherwise without prejudice to Your ownerships rights, which are retained by You.

12. Requests to remove content
You may ask for content to be removed from the Youth Justice Resource Hub, for example if it breaches copyright laws, contains sensitive personal data or includes material that may be considered obscene or defamatory.

Please email us at the contact address provided, giving the details and address of the content You would like removed and why. We shall acknowledge Your request and let You know what We will do.

Publication is at our sole discretion. This policy doesn’t affect Your statutory rights to request information, including the Freedom of Information Act 2000 and the Data Protection Act 1998.

13. Virus Protection
We make every effort to check and test material at all stages of production. However, You shall take Your own precautions to ensure that the process that You employ for accessing this website does not expose You to the risk of viruses, malicious computer code or other forms of interference which may damage Your own computer system. We shall not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect Your computer equipment, computer programs, data or other proprietary material due to Your use of our Site or to Your downloading of any content on it, or on any website linked to it.

14. Viruses, hacking and other offences
You shall not misuse our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You shall not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You shall not attack our Site via a denial-of-service attack or a distributed denial-of-service attack.

By breaching this provision, You would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and We will co-operate with those authorities by disclosing Your identity to them. In the event of such a breach, Your right to use our Site will cease immediately.

15 Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any dispute arising under these Terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Waivers
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights. If We waive any rights available to us under these Terms on one occasion, this does not means that those rights will automatically be waived on any other occasion.

17. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, such provision shall be severed and the remainder of the provisions of these Terms will remain in full force and effect.

18. Entire Agreement
These Terms constitute the entire agreement between us regarding our website, and supersede and replace any prior agreements. We might have between us regarding the Youth Justice Resource Hub.

19. Changes
We reserve the right to modify or replace these Terms at any time without notice. Please check them regularly, as continued use of the Youth Justice Resource Hub after a change has been made is Your acceptance of the change. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Site after those revisions become effective, You agree to be bound by the revised Terms.
